Ademais, o Código de Processo Civil, em seu art. 6º, estabelece o princípio da cooperação, impondo aos sujeitos do processo o dever de colaborar para que se obtenha, em tempo razoável, decisão de mérito justa e efetiva. A requisição judicial de documentos (art. 438 do CPC) é medida excepcional, cabível apenas quando demonstrada a impossibilidade de obtenção direta ou a recusa injustificada do órgão administrativo. No âmbito do Programa Moradia Legal, embora se busque a máxima celeridade, a responsabilidade pela instrução técnica e documental mínima permanece com as partes interessadas.  Assim, indefiro, por ora, o pedido de expedição de ofício para requisição de documentos/certidões feito ao mov. 283.1. Intime-se a parte interessada para que promova a solicitação diretamente perante o órgão público competente. Caso haja recusa formal ou omissão do órgão público em fornecer a documentação no prazo legal, deverá a parte colacionar tal prova aos autos, momento em que este Juízo apreciará a necessidade de medidas coercitivas ou expedição de mandado.
